Hachette Livre may collect and process personal data when you visit the website hachette.com (hereinafter the “Site”). Any information relating to a natural person who could be identified directly or indirectly (for example, by their last name, first name, user name, e-mail address, location data, etc.) is an item of personal data (hereinafter the “Personal Data” or “Data”).

Hachette Livre places great importance on protecting the privacy and data of Site users. This Policy sets out the types of processing for which Hachette Livre is responsible, in accordance with the regulations in effect. This document aims to inform users about how Personal Data is collected, used and processed.

Hachette Livre reserves the right to amend any or all of the rules relating to privacy protection at any time and without notice. Any amendments will come into effect on the day they are published on the Site and applicable to users on their first use of the Site after the publication of said amendments.

In order to ensure compliance with the applicable legislation and in accordance with its regulatory obligations, Hachette Livre has appointed a Data Protection Officer (DPO), who manages the security of information systems at Hachette Livre. You may write to them at the following address: Hachette Livre, for the attention of the DPO, 58, rue Jean Bleuzen 92170 Vanves.

ARTICLE 1 – DATA CONTROLLER

The company Hachette Livre, at 58, rue Jean Bleuzen 92170 Vanves, registered with the Nanterre Trade and Companies Register under no. 602.060.147, is responsible for the processing of Personal Data that takes place on its Site.

ARTICLE 2 – DATA COLLECTED

Hachette Livre collects personal data via the Site to offer an online applications service. This service is reserved for users of legal working age, who guarantee this to Hachette Livre. By communicating their Personal Data voluntarily, the user expressly agrees that their data may be collected and processed for the purposes of which they have been made aware. Providing an e-mail address is required to create an “applicant area” and in so doing, access the online applications service. This allows Hachette Livre to communicate with the user, in particular to send confirmations and responses to their applications.

Users may upload their CV and attachments, in particular covering letters and letters of recommendation, by logging into their applicant area.

The applicant area also allows the user to set up alerts by key word and occupation, selecting the level of education chosen and preferred location.

Hachette Livre collects this data in order to recruit staff for both published vacancies and in response to unsolicited applications.

In addition, Hachette Livre may use cookies, tools and software to analyse and gather non-personal data.

This is general, aggregated or demographic information, which may be provided in relation to surveys, studies or anonymous aggregated data concerning the use of the Site, the type of internet browser, the operating system, the length of the visit or the pages viewed. This data is collected for statistical and security purposes and helps Hachette Livre to improve the quality of its services. Users can decide whether or not to provide this information. For more information, see the Cookies Policy available here: http://hachette-com.pprod.hachette-livre.fr/fr/transverse/charte-cookies-fr/

ARTICLE 3 – RECIPIENTS OF PERSONAL DATA

The Personal Data collected by Hachette Livre is intended for the Hachette Livre group only and will not, under any circumstances, be sold or leased to third parties. The Personal Data may, however, be communicated to Hachette Livre’s third-party technical service providers, solely to ensure the smooth operation of the Site and the services offered via the Site.

Hachette Livre undertakes that the Personal Data collected in relation to the use of the Site will not be transferred outside Europe.

ARTICLE 4 – PERSONAL DATA RETENTION PERIOD

Hachette Livre only retains Personal Data for as long as required for the smooth running of the recruitment process and services offered via the Site.

Hachette Livre retains data for 24 months so that it can contact users should an opportunity that matches their profile arise.

The Personal Data associated with an applicant area will be deleted within twenty-four (24) months of the closure of said account, unless otherwise requested by the user.

ARTICLE 5 – PERSONAL DATA SECURITY AND PROTECTION

The Personal Data collected by Hachette Livre is kept in a secure environment. It is hosted by the service provider identified in our Statutory Notices.

Hachette Livre implements all appropriate physical, technical and organisational measures to ensure the security and confidentiality of Personal Data, in order to protect it from any loss, accidental destruction, alteration or unauthorised access.

However, Hachette Livre cannot control all the risks associated with the internet. In this respect, users visit the Site at their own risk and Hachette Livre cannot be held liable for any security flaws that it is unable to mitigate.

ARTICLE 6 – USERS’ RIGHTS

Hachette Livre guarantees its users respect for the rights provided in the French Data Protection Act no. 78-17 of 6 January 1978 as amended, and Regulation (EU) no. 2016/679 of 27 April 2016 on the protection of personal data, in particular the right for users to decide on and control the uses made of their Personal Data.

Users are reminded that in accordance with said regulations, they have the right to access, correct, and delete their personal data but also a right to limit processing.

Insofar as the processing carried out in relation to use of the Site relies on users’ consent, they may withdraw such consent at any time.

Users may also, on legitimate grounds, object to their personal data being processed by Hachette Livre. This means that users must reject the use of their personal data for certain purposes mentioned when the data is collected. As a result, they may no longer be able to use certain services.

Pursuant to articles L. 224-42-1 et seq. of the French Consumer Code, users have the right to recover all their data, in a structured format, under all circumstances.

Finally, users may set out their instructions on the retention, deletion and communication of their Personal Data after their death. Unless they have appointed someone to carry out these instructions, they will be communicated to their heirs, who will implement them on their behalf. Users may amend or revoke their instructions at any time.

You may exercise all your rights electronically by sending a request to: drhe@hachette-livre.fr, or by post to Hachette Livre, 58, rue Jean Bleuzen, 92170 Vanves.

ARTICLE 7 – APPLICABLE LAW AND APPEALS

This confidentiality policy is governed, interpreted and applied in accordance with French law.

In the event of a dispute over the processing of their Personal Data in relation to their use of the Site, the user and Hachette Livre undertake first to seek an amicable solution in good faith.

Failing this, the user may submit a complaint to the Commission Nationale de l’Informatique et des Libertés (CNIL) or refer the case to the relevant courts.
